An early morning altercation over the weekend between two neighbors in a Lexington, South Carolina, neighborhood left the aggressor dead after he was shot by the man he was attacking.
Police received a 911 call around 2:30 a.m. Sunday and when they arrived on the scene, they found Derek Fogle, 31, lying in a yard with multiple gunshot wounds. He was transported to a local hospital where he was later pronounced dead.
In what police are calling “an unprovoked attack,” Fogle yelled as he approached Joseph Scott Nicewonger’s home. According to reports from local media, Nicewonger was in his garage at the time and Fogle chased him through his yard, then threw Nicewonger to the ground and repeatedly struck him in the head.
Nicewonger, who was armed with a handgun during the altercation, told authorities he shot Fogle to end the attack, then immediately called 911.
Witnesses said prior to the shooting, Fogle had walked through several yards as he banged on doors and yelled.
Without providing further detail, authorities stated they believe Fogle may have been in an “altered mental state.” As part of the investigation, an autopsy will be performed on Fogle, which will include toxicology tests.
