Democrat U.S. Sens. Cory Booker (N.J.), of the Senate Judiciary Committee, and Andy Kim (N.J.) are attempting to revive the Federal Firearm Licensing Act, requiring would-be gun owners to first obtain a federal firearm license.
The proposed bill was introduced last week, skipping right past the U.S. Constitution’s Second Amendment and specific details in a rush to comprehensive gun control over all Americans. While the senators’ press release pitches the bill as a simple, “commonsense” measure, it is chalked full of vague but expansive government controls.
Under the proposed scheme, it would be illegal for any person to “purchase, receive, or possess a firearm unless the individual has a valid federal firearm purchasing license.”
Along with creating a de facto federal gun registry, acquiring such a permit would be no small feat under the bill’s hefty list of demands that include:
Completion of yet-unnamed training, including hands-on instruction, a written test, demonstrated knowledge of ever-changing firearms laws, and unspecified accuracy proficiency testing
Completion of a poorly defined background investigation and criminal history check
Submission of proof of identity
Required reapplication for a license every five years
Submission of fingerprints
Submission of the make, model, serial number, and identity of the firearm seller for each gun
Revocation of the license if the individual “poses a danger” to themselves or others
Regular FBI checks to ensure continued compliance
Requirements to inform “relevant law enforcement agencies” of any future sale or other disposal of the firearm
Up to 30 days of waiting for approval or denial
And various other measures
The legislation goes even further, stating that “each license issued under this section shall be valid for the purchase of a single firearm, which shall be purchased not later than 30 days after the date on which the license is issued.”
The 11-page bill proposal is scant on specifics and big on sweeping demands that are vague enough for broad interpretation.
“If a license is required to drive a car, it should be required to own a gun,” said Booker in a press release that omits any mention of constitutionality and many of the added hurdles listed above. “The Federal Firearm Licensing Act brings this common-sense idea to every community in the nation, mandating background checks and proper training before a license is issued.”
The move is in lockstep with anti-gun groups Giffords and Community Justice Action Fund, both endorsers quoted in the senators’ press release.
All currently listed cosponsors are Democrats from states with already expansive anti-gun legislation, including Sens. Brian Schatz (D-Hawaii), Elizabeth Warren (D-Mass.), Richard Blumenthal (D-Conn.), Adam Schiff (D-Calif.), Alex Padilla (D-Calif.), and Mazie Hirono (D-Hawaii).
