Dashcam video shows police officer shove paraplegic out of wheelchair for running over foot (VIDEO)

Dashcam footage has been released of the Lafayette police lieutenant who shoved a paraplegic man out of his wheelchair after he ran over his foot last year.

On Oct. 1, 2013, Nicholas Kincade, 25, told Excel Center school security he had a gun in his backpack, which was later determined to be false. Police responded to the scene and Lt. Tom Davidson talked with Kincade, ultimately giving him a trespass warning and telling him to leave. As Kincade was driving away in his wheelchair, he rolled over Davidson’s foot, CBS News reports.

Davidson shoved Kincade and he toppled onto the ground. Kincade was arrested and after an internal review of the incident, Davidson was demoted.

“It’s clear to us that the whole use of force in this case could have been avoided just by different positioning, by offset positioning, by moving out of the way, by not standing where he was standing,” said Police Chief Patrick Flannely. “Police officers cannot put themselves in a position where the subsequent need to use force is created.”

On top of being demoted, Davidson was also issued a 30-day suspension without pay.

“He made his mistake,” Flannely said. “He’s received the punishment. We’ve spoken. The merit board has spoken. The process is done. At this point we move forward.”
